DELIVERY, WARRANTY AND RETURNS
SHIPPING
All prepared orders are shipped out with delivery services of your choice the second day after payment and will get to you by parcel machine or by delivery man to your given address.
If you desire parcel to be delivered to a specific address, please give the exact details and it will be shipped out via delivery man.
If it is more comfortable to get delivery to parcel machine, name the delivery company - LP Express / DPD / Omniva - and exact adress of your chosen parcel machine.
In Lithuania's territory shipping is free and may take from 1 to 10 business days.
Shipping to European Union country costs 5 euros and may take from 3 to 15 business days. If the shopping cart amount is 80 euros or more - shipping is free of charge.
For delivery to non European Union country, contact me before making an order. Shipping to non European Union country is different not only by shipping price or customs fee, but also by documentation. For this reason such shipping requires more attention.

OTHER INFORMATION CONSIDERING DELIVERY

The Seller is in all cases released from liability for late delivery of goods if the goods are not delivered to the Buyer on time due to the Buyer's fault (incorrect delivery address) or due to circumstances beyond the control of the Seller, including, but not limited to, the acts or omissions of third parties delivering the consignment.

Upon delivery of the goods to the address specified by the Buyer, the goods shall be deemed to have been delivered to the Buyer regardless of whether the goods are accepted direclty by the Buyer or any other person who has received the goods at the specified address. The Seller is not responsible and does not check whether the goods are picked up by the person specified in the order.

If the Buyer gives an incorrect or incomplete delivery address or does not collect the goods from the person providing the shipping service or the postal terminal within the maximum storage period, the Buyer must pay the Seller's additional costs for returning the shipment and re-sending the goods to the Buyer's specified address.

Upon delivery of the goods, the Buyer (the Buyer's representative) undertakes and must check the condition of the packaging of the consignment, the quantity, quality (obvious defects) and range of the goods. If the packaging of the delivery is violated, the Buyer (the Buyer's representative) must note this in writing to the person who delivered the goods (if the delivery is made with a courier service) in the delivery acceptance document or refuse to accept the delivery. The Buyer must immediately inform the Seller and provide photos of the damaged shipment and / or goods. If the quantity and / or quality and / or assortment of the goods are found to be non-compliant, the Buyer (the Buyer's representative) must not accept the delivery. After the Buyer (the Buyer's representative) accepts the delivery and signs the document without comments, it is considered that the goods are delivered in undamaged packaging, the quantity and range of goods comply with the order conditions and that the goods have no obvious defects.

If the Buyer picks up the goods at the parcel machine and if the packaging of the parcel is damaged, the Buyer must immediately inform the Seller and provide a photo of the damaged parcel and do not unpack it. Depending on the damage to the packaging of the parcel, the Seller may request the Buyer to return the delivery. If the damaged parcel is unpacked without the Seller's confirmation or if Seller was not even informed about the damage to the delivery's packaging, the goods will be deemed to have been delivered in the intact parcel and the quantity and range of goods comply with the order conditions.
WARRANTY

The details of the goods sold in the online store are indicated in the product description next to each product.

The color, shape or other parameters of the goods presented in the online store may not correspond to the actual size, shapes and colors of the goods due to the characteristics of the monitor used by the Buyer. This is not considered to be a defect in the product or a discrepancy with the product description.

The quantities of goods displayed in the online store in the photos are not always related to the price of the goods - the price of more than one unit of goods may be displayed. The units of measurement are specified in the product description.

The Seller guarantees the quality of the Goods (statutory quality guarantee). The Seller may provide a quality guarantee valid for a certain period of time for different Goods, the specific term and other conditions which are specified in the description of such Goods. All goods are marked with the Seller's responsibility mark and tested at the Lithuanian Assay Office (Lietuvos prabavimo rūmai).

The Buyer is informed that the jewelry may scratch due to contact with each other or other surfaces, it is advisable to keep them separate from each other, to avoid contact with sharp surfaces, to protect them from shocks, other possible mechanical damage. Jewelry must also be protected from contact with chemicals, sudden changes in temperature, heat, salt-saturated or chlorinated water. Jewelry, especially if not worn or stored in a damp room, can change its color and oxidize. These changes are not considered non-compliance of the product with the quality requirements. In order not to damage the surface, jewelry must be cleaned with special materials and tools.

The Buyer may apply to the Seller for a free renewal of the goods no more than once a year after the purchase of the goods, but without limiting this term (all year until the Seller continues to operate). Delivery costs for the goods to be renewed shall be paid by the Buyer, unless otherwise agreed with the Seller.
RETURNS

According to the Resolution of the Government of the Republic of Lithuania no. 697 of the approved Retail Trade Rules (wording of 29/07/2014), item 17.12, high-quality pearls, precious stones, precious metals and articles thereof purchased at local points of sale, except imitation jewelery (codes according to the Combined Nomenclature - 7101–7116, 7118) are unchanged and non-refundable.

The Buyer-consumer has the right to refuse the purchase-sale agreement concluded in the online store with the Seller without giving a reason by notifying the Seller in writing within 14 calendar days from the date of receipt of the goods. The Buyer must submit a notice to the Seller by email info@mirtyna.com. The notice must clearly state that the Buyer withdraws from the sales contract, returns the goods and requests a refund of the money paid (indicating the Buyer's account to which the Buyer wishes to receive a refund), a document confirming the purchase of the goods from the Seller.

The Buyer-consumer may use the right to return the goods only if the aforementioned 14-day return period has not expired. The Buyer must deliver the product to the address specified by the Seller Užubalių g. 7, Miklusėnai, Alytus r. sav. LT-62466 or sent by registered mail/courier service, with delivery to the consignee. Until the returned goods are delivered to the Seller, the risk of loss or damage of the goods rests with the Buyer.

According to RETURN 2., the returned goods must be undamaged, free from signs of mechanical damage, without loss of commercial appearance, with all previous labels, quality certificates, in proper original packaging, not used. In case of defects in the goods or their packaging or signs of wear of the goods, the cancellation of the sales contract cannot be enforced, the Seller has the right not to accept the returned goods and not to return the money to the Buyer. In this case, the Buyer has the right to withdraw the goods from the Seller.

The Buyer-consumer who has withdrawn from the sales contract in accordance with the RETURN 2., shall be refunded all money paid for the goods, excluding the costs of delivery of the goods to the Buyer, if the goods are returned before the deadline and meet the requirements of the RETURN 3. The Buyer must bear the direct cost of returning the goods. Upon receipt of the returned goods, the Seller returns the money to the Buyer-consumer to the bank account indicated by him/her only after checking the returned goods herself or at the Lithuanian Assay Office (depending on the goods) to make sure that the goods are returned as shipped. Inspection of returned goods at the Lithuanian Assay Office is the Seller's right, but not the obligation.

According to the RETURN 2., the right of withdrawal does not apply and the Buyer may not exercise it in respect of goods made to the Buyer's special order: goods made as individual order, which were made according to the Buyer's personal choice or instruction, or goods that were adapted to the Buyer's personal needs (for example, a changed size of the jewelry, etc.).
